English

    12 septembre 2026 | intercultural.info

  • What now? — extraordinary regularisation 2026: what to do according to the status of your file

What now? — extraordinary regularisation 2026: what to do according to the status of your file

This article is also available in: English Español العربية Français

    12 September 2026 | intercultural.info

In brief: the application period for the extraordinary regularisation closed on 30 June 2026, but the process is not closed. If you submitted your application in time, you have until 30 September to complete your documentation. And if your file remains without a response, an official criterion of July 2026 confirms that administrative silence does not withdraw the provisional authorisation to reside and work. Here we specify what to do according to the status of your file.

The application period for the extraordinary regularisation closed on 30 June 2026. According to the report of the Ministry of Inclusion, almost 1.2 million applications were registered. If you are one of those persons, it is natural to wonder what happens next.

The answer depends on the status of your file. And there is something you should know from the outset: the closure of the application period does not mean that the process is closed. If you submitted your application in time, you may still complete your documentation — as we explain in point 2. Here is a brief guide for each situation.

    1. If you have already received a favourable decision

Congratulations: this is the best scenario. From the moment your authorisation is granted, you have one month to request your TIE (Tarjeta de Identidad de Extranjero, the foreign national identity card). Consult the notification to ascertain where you must request the appointment (cita previa), assemble the documentation indicated to you and do not allow that month to elapse.

A glance towards the future, so that nothing surprises you: this authorisation is valid for one year. Before it expires you will have to proceed to the next stage and modify it into an ordinary category of the Immigration Regulations (an arraigo, for instance). You may request that modification from two months before its expiry. The first year passes quickly: the preservation of your legal status is what will permit you to continue without difficulties.

    2. If you have received the notification of commencement, or you are still awaiting it

For the majority of people, this is the best news of the moment. From the notification that the processing of your application has commenced, you may already reside and work, without awaiting the final decision. That notification is the document that confirms it: it states expressly that you are provisionally authorised. From that moment:

    • You receive your NUSS (Social Security number) automatically.
    • You obtain the authorisation to work as an employee and as a self-employed person (por cuenta ajena y por cuenta propia), throughout the national territory and in any sector.
    • You are entitled to healthcare.

That is to say: although your file continues its course, you may sign a contract, register with the Seguridad Social and consult a doctor.

An important observation: this authorisation does not derive from the mere submission of the application, but from that notification of commencement. If you have not yet received it, remain patient and do not assume that you are already permitted to work.

Administrative silence does not withdraw that authorisation

This is the most frequent doubt. If three months elapse and nobody responds, do you lose the right to reside and work? No. The Directorate-General for Migration Management clarified this in an interpretative criterion signed on 22 July 2026, whose conclusion, in our translation, specifies the following.

“The presumed rejection produced by administrative silence does not extinguish the provisional authorisation to reside and work recognised with the notification of commencement of the procedure, which shall remain valid until the notification of the corresponding express decision. Only an express decision of refusal shall produce the automatic loss of that authorisation […]”

In other words: your authorisation does not last three months. It lasts until the decision arrives. And only an express refusal, duly notified, withdraws it.

Extract from the criterion of the DGGM concerning persons who have already received the notification of commencement
Criterion of the DGGM of 22 July 2026, the situation of persons who have already received the notification of commencement.

According to the affiliation report of the Ministry of Inclusion, Social Security and Migration, on 31 August 2026 there were 337,917 persons affiliated to the Social Security under this provisional authorisation.

You may complete your documentation until 30 September

This is the point that most people ignore, and probably the most useful in the entire article. Once the application period concluded, a period for the completion and correction of documentation (subsanación) was opened, which extends until 30 September 2026. It is intended for those who submitted their application in time, and it serves two purposes:

    • On your own initiative: if you realise that a document was missing, or that you provided an incomplete or erroneous one, you need not wait until it is requested from you. You may complete your file on your own account.
    • In response to a formal request (requerimiento): if the Administration demands documentation from you, this is the channel through which you must provide it.

You may proceed electronically or in person: Correos designated 383 offices for the completion of files until that date, according to the company’s own note of 1 July 2026. Consult the Correos page on the extraordinary regularisation for the offices available each month and the conditions of attention.

A warning that may determine whether you obtain your authorisation or lose it: if you receive a requerimiento, the period for a response is the one specified in the notification itself and will never exceed fifteen days. Note carefully: it may be shorter, so read the notification attentively and do not postpone your response. If that period elapses without a response, you will be deemed to have withdrawn, your file will be closed and you will lose the opportunity to obtain residence through this extraordinary regularisation. Consult frequently the channel through which you submitted the application — and if you acted through a representative, communicate with the person who represents you — because that is where the notifications will arrive.

    Two important clarifications

If you are still awaiting the notification of commencement from the UTEX: remain patient. That notification is the document which confirms that your file has commenced, and it is not the same as the receipt of submission (justificante de presentación) which you obtained upon applying. They are two distinct documents: the receipt demonstrates that you submitted the application; the notification of commencement demonstrates that your file is already in progress and that you are authorised to work.

The July criterion also contemplates this situation. If you have not yet received the notification of commencement and three months have already elapsed, the Administration retains the obligation to issue a decision. You will subsequently receive both that notification and the final decision.

Extract from the criterion of the DGGM concerning persons who have not yet received the notification of commencement
Criterion of the DGGM of 22 July 2026, the situation of persons who have not yet received the notification of commencement.

In the meantime, examine the channel through which you submitted your application and also your spam folder. Many communications arrive there and pass unnoticed.

If the criminal record certificate from your country of origin is still pending: this is one of the points that causes most concern, but a route is provided. Your application may be sustained by the provision of three items: the receipt evidencing that you have already requested the certificate, a responsible declaration (declaración responsable) stating that one month has elapsed without a response, and the authorisation for the Spanish authorities to obtain it through diplomatic channels. In that case, the UTEX will request the Ministerio de la Presidencia, Justicia y Relaciones con las Cortes to obtain it by that route, and the procedure remains suspended for a maximum of three months. If those three months elapse and the certificate has not arrived, the UTEX will request it from you and you will have fifteen days to provide it. Respond within the period so as not to lose your application. In the meantime, your authorisation to work is preserved.

    3. If your application has been refused, or the period has elapsed without a response

The maximum period for a decision is three months. That period commences from the entry of your application in the register of the body competent to process it, not from the day on which you delivered the documents.

If the three months elapse and you receive no response, the law considers that your application has been rejected by administrative silence. However, that silence does not withdraw the provisional authorisation, according to the criterion of the Directorate-General for Migration Management of 22 July 2026. Neither an express refusal nor silence constitutes the end of the road: you are entitled to appeal.

Heading of the interpretative criterion of the Directorate-General for Migration Management of 22 July 2026
Heading of the interpretative criterion of the DGGM. Select the image to consult the complete document.
    • Against an express refusal, you may submit an administrative appeal (recurso de alzada) within one month from the notification.
    • Against administrative silence, the administrative appeal is likewise admissible, in this case without a limitation period that constrains you. And the contentious-administrative jurisdiction always remains available.

A clarification merits attention: an appeal against silence constitutes a right, not an obligation. As no period expires, you may await the express decision without any loss. And if you already possess the notification of commencement, you remain authorised to reside and work during that wait.

Consider, moreover, that those three months may be suspended in certain situations. For example, while a request for documentation is resolved. Some files therefore require more time without this signifying that anything is wrong.

The periods are strict and each case is different, so this is the moment to seek professional assistance. A refusal is frequently attributable to a missing document or to a correctable detail, and not to an absence of entitlement. That is why the previous point merits emphasis: correction in time prevents refusals. If your file remains active and you suspect that something is missing, act before a negative decision arrives.

💡 Uncertain where to commence? An accredited collaborating organisation may examine your case and orient you free of charge.

    4. If you were unable to submit the application in time

Not everything concludes with this period. The ordinary routes of arraigo (social, employment-related, family or for training purposes) remain permanently available, independently of this extraordinary process. In the meantime: continue to construct your arraigo. Maintain your empadronamiento (municipal registration) current and preserve any evidence of your presence and of your life in Spain. Every documented month counts. When you satisfy the requirements of an ordinary arraigo, you will be able to apply for it.

Español English Français

2026 | intercultural.info

English Français

English

    5 juin 2026 | intercultural.info

Pedir información no te compromete a nada.

Tener tus papeles cambia tu vida: te permite trabajar, moverte, pedir ayuda y decidir por ti misma. Quedan pocas semanas. Da el paso por ti.

    5 June 2026 | intercultural.info

In brief: the 2026 extraordinary regularisation is an individual right that you can apply for yourself, without anyone’s permission, before 30 June. Here we explain how to apply, how to check the status of your file, and whom to contact if you suffer abuse.

If you have not yet applied for the regularisation, or if someone applied on your behalf and you do not know its current status, this text is for you. Less than a month remains.

The deadline for applying for the extraordinary regularisation of 2026 concludes on 30 June and, in principle, will not be extended. As of today, less than four weeks remain. Some women will reach that date without having applied, simply because nobody has explained to them that they hold this right, or because someone has persuaded them that they can do nothing on their own.

We are aware that, for some of you, taking this step is not simple. Some women live under the control of a pimp or of whoever exploits them: they retain their passports, maintain them without documents, and intimidate them so that they will not emerge from concealment, because a frightened woman without documentation is easier to control, easier to subdue. In other cases it is the partner, or the husband, who utilises the papers as one further form of abuse, exploiting the fact that she does not speak the language well, that she is uninformed, and that she is alone, with nobody she may approach.

Many of these women are mothers. And many have heard the same threat repeated for years: that if they act, their daughters and sons will be taken from them, that they will be expelled from Spain, that they will be confined. They state this precisely so that the women will not dare. Women who survived trafficking and prostitution —a substantial proportion of them migrants— have recounted it publicly: this is how fear is constructed, and this is how submission is sustained; and those of us who work in the field of migration and with women who are victims of gender violence are acquainted with several such cases.

This is why this message is important.

    You can do it yourself

The regularisation application is individual. You require no man’s permission, nor his signature, nor his presence. You do not depend on him to obtain your papers. Your residence is a right of yours, not a favour that anyone grants you or may withdraw.

What you are able to do is to attend, yourself, the social services of your town council, or an accredited collaborating entity. There they explain to you how to submit the application, they provide guidance free of charge, and they even submit it on your behalf if they possess the capacity to do so. If you do not speak Spanish well, declare this without reservation: many of these entities work with mediators and interpreters and are accustomed to assisting women in your situation.

    🤝

Find an organisation that can help you

Locate accredited organisations near you that provide free guidance and can submit the application on your behalf.

The regulation furthermore recognises that finding oneself in an irregular situation —with everything that this entails on a personal, economic, and social level— may in itself constitute a situation of vulnerability. The social services or a collaborating entity may issue the vulnerability certificate that attests to this, and that procedure is likewise free of charge.

And what if you were told that it has already been submitted?

You have the right to know whether this is true and at what stage it is, and you can verify it yourself. For this you require one item of data: your NIE number (foreigner’s identity number) or the file number EXPE (expediente, the application file number) —both are assigned once the regularisation application has been admitted for processing. There are two ways to do this.

By SMS (text message). Send a message to 651 714 610: it is free of charge and you will receive a reply with the status of the procedure. If you use the NIE, write the word NIE in Latin characters, leave a space, and add your complete NIE —it commences with X, Y, or Z, contains eight digits, and concludes with a letter, for example X00000111L. If you use the file number, write EXPE in Latin characters, leave a space, and add the number (it comprises fifteen characters).

By internet, on the electronic office (the official page is infoext2.delegaciondelgobierno.gob.es). There you may enter in two manners:

    • with digital identification (Cl@ve or electronic certificate), if you possess it; or
    • without digital identification, by completing a form. It will request your NIE, the date on which the application was submitted, and your year of birth, and you will have to copy a small security code (a captcha) that appears on the screen. You may also search directly by the file or application number.
Screen for choosing between Entrada con Cl@ve and Entrada con formulario on the electronic office
The electronic office: the screen for choosing between «Entrada con Cl@ve» and «Entrada con formulario».
Form on the electronic office showing the fields for NIE, date of submission, and year of birth
The form requesting the NIE, the submission date, and the year of birth.

If you do not possess that data, do not remain in doubt: at the social services or at a collaborating entity they can assist you in ascertaining it. Nobody has the right to conceal from you the information regarding your own situation.

If what you experience at home is abuse

There is a telephone number you can call: 016. It responds in numerous languages twenty-four hours a day, it is free of charge, and it leaves no trace on the telephone bill. Requesting information commits you to nothing.

Possessing your papers changes your life: it permits you to work, to move, to request assistance, and to decide for yourself. Few weeks remain. Take the step for yourself.

Red Acoge.

Extraordinary regularisation 2026 in Spain: what is known, who is eligible, and what you should do now

ℹ️ Archived content: the application period for the extraordinary regularisation closed on 30 June 2026. This article is retained for reference and may not reflect the current situation.
This article is also available in: Español العربية English Français

    Updated 15 April 2026 | intercultural.info

Royal Decree 316/2026 on the extraordinary regularisation was published on 15 April 2026 in Spain’s Official Gazette (Boletín Oficial del Estado) and entered into force on 16 April. What had remained a draft for months is now an official regulation: foreign nationals residing in Spain without a valid residence permit, or who applied for asylum before 1 January 2026, may apply for a residence and work permit.

In this article we explain the confirmed requirements, the key dates and what you need to do to submit your application.

✅ Published in the Official Gazette: Royal Decree 316/2026, dated 14 April, has been published in the BOE on 15 April 2026 (reference BOE-A-2026-8284). It enters into force on 16 April. The information in this article reflects the official published text.

    What is this regularisation?

It is an exceptional, time-limited process that enables foreign nationals without a valid residence permit to obtain a residence and work permit in Spain. The Government estimates that approximately 500,000 people may benefit. It has been approved by Royal Decree — without requiring parliamentary approval — and modifies the Immigration Regulations (Royal Decree 1155/2024) by introducing two new additional provisions.

    Who is eligible?

The Royal Decree establishes two pathways:

Pathway 1: If you applied for asylum before 1 January 2026

You may apply for this regularisation even if your asylum claim has been refused or remains pending. You are not required to withdraw from the asylum procedure in order to apply: you will only need to withdraw your asylum application or appeal if you receive a favourable decision on the regularisation. You are considered an international protection applicant from the moment you expressed your intention to apply.

Pathway 2: If you are without a valid residence permit and did not apply for asylum

In addition to the general requirements (see below), you must demonstrate at least one of the following three circumstances:

    • Employment: having been employed or self-employed during your time in Spain, or demonstrating the intention to work by presenting a job offer (a contract or combination of contracts exceeding 90 days in one year) or a responsible declaration of self-employed activity.
    • Family ties: residing in Spain with minor children, adult children with a disability requiring support, or direct ascendants of the first degree.
    • Vulnerability: a situation certified by means of a certificate — which may be downloaded from the regularisation portal — endorsed by social services or by an entity registered in the Registry of Immigration Collaborating Entities (RECEX). The regulation recognises that an irregular administrative situation, together with the personal, economic or social circumstances arising from it, may in itself constitute vulnerability.

Persons who already hold a valid residence or stay permit — or who have a pending application for authorisation — are not eligible. Nor are beneficiaries of temporary protection from Ukraine, who are covered by a separate procedure.

    Main requirements

These are cumulative — you must satisfy all of them:

    • You must have been present in Spain before 1 January 2026. This may be evidenced by any document bearing your name and a date: passport with an entry stamp, tenancy agreement, utility bills, medical reports, municipal registration (empadronamiento), remittance receipts, etc.
    • You must have at least 5 months of uninterrupted presence in Spain at the time of submitting your application. The term «uninterrupted» is retained in the final text.
    • You must have no criminal record in Spain or in the countries where you resided during the five years prior to your entry into Spain. You must provide the criminal record certificate from your country of origin. If you have requested it and have not received it within one month, you may submit a responsible declaration to that effect and authorise the Spanish authorities to obtain it through diplomatic channels. Expungable offences in Spain are not taken into consideration.
    • You must not represent a threat to public order or be subject to an entry ban in Spain.
    • You must pay the processing fee: €38.28.

    What will you receive?

A one-year residence and work permit, valid for any sector and throughout Spain. From the moment the Administration notifies you that processing of your application has commenced, you will be provisionally authorised to work, both as an employee and on a self-employed basis. You will also receive a Social Security affiliation number and a health card. For your minor children, the residence authorisation is for five years.

After the first year, you will need to apply for a modification through the standard pathways provided in the Immigration Regulations. If you are unable to obtain a modification, it is possible to request an extension by demonstrating active employment-seeking.

The maximum period for a decision is three months. If the Administration does not issue a decision within that period, the application is deemed refused by administrative silence. Following a favourable decision, you have one month to apply for your Foreign National Identity Card (Tarjeta de Identidad de Extranjero — TIE) at the National Police.

    When and where?

⚠️ Non-extendable deadline: Applications must be submitted before 30 June 2026. There will be no extension.

    These are the key dates:

    • 16 April: the online application channel opens (24 hours a day, 7 days a week) together with the appointment system for in-person attendance.
    • 20 April: in-person service begins at designated offices, by appointment only.
    • 30 June: application deadline. Non-extendable.

Applications may be submitted online (with a personal electronic certificate, through the Registry of Powers of Attorney, via a lawyer, a social affairs graduate or an administrative agent, or through entities registered in the Registry of Immigration Collaborating Entities) or in person, always by appointment, at designated Social Security offices, Correos (postal service) branches and certain immigration offices. Information will be available on the portal inclusion.gob.es/regularización from 16 April.

Appointments may be requested through the regularisation portal (with or without Cl@ve) or by telephone on 060 (service in Spanish, Monday to Friday from 09:30 to 14:00 and from 16:30 to 19:30).

    Who can assist you?

The Registry of Immigration Collaborating Entities (RECEX — published in the Official Gazette on 5 March 2026) enables registered trade unions and NGOs to advise you free of charge and to submit applications on your behalf. Licensed professionals may also assist you: lawyers, social affairs graduates and administrative agents.

Important notice: cases of fraud and abuse are being detected. Nobody can «reserve a place or an appointment» for you before the system becomes operational tomorrow, 16 April. Do not pay anyone for procedures that are free of charge through collaborating entities. If you have any doubts, consult only official sources or recognised organisations.

    What to do now

    1. Gather your documents: everything that evidences your presence in Spain before 1 January 2026 and during the past 5 months. Organise them by date.
    2. Ensure you are registered at your local council (empadronamiento). Municipal registration is not mandatory for the application, but it is an extremely useful document for evidencing your presence. It is free of charge and your administrative situation is irrelevant.
    3. Request your criminal record certificate from your country of origin if you do not already have one. If you have already requested it and have not received it within one month, the regulation provides a mechanism for the Spanish authorities to obtain it through diplomatic channels.
    4. Do not leave Spain until you have submitted your application. Your presence must be uninterrupted during the 5 months preceding the application.
    5. If you have a pending arraigo application, no additional action is required. The Royal Decree provides that arraigo applications submitted since May 2025 will be determined under the requirements of this regularisation.
    6. If you intend to submit your application online, you will need an electronic certificate. We explain how to obtain one here: Digital certificate for foreign nationals in Spain. If you do not have an electronic certificate, you may submit your application in person or through a representative.
    7. Consult only reliable sources: the portal inclusion.gob.es, La Moncloa, and organisations such as CEAR, Cruz Roja (Red Cross), Accem or Red Acoge.

    Pending: the application form

The application form and the accompanying socio-occupational questionnaire will be available for download on the regularisation portal (inclusion.gob.es) from 16 April. As soon as they are published, we will update this article with direct links.

    Summary

The regularisation is now official. The application window opens tomorrow, 16 April, and closes on 30 June — just over two months. It is not an automatic process: you must gather documents, satisfy the requirements and submit your application on time. But it represents a genuine opportunity for hundreds of thousands of people. At intercultural.info we will follow the process closely and explain every step.
